Return policy – B & S Commerce EOOD
Please be advised that, under the Consumer Protection Act (CPA), you are entitled to return the product purchased from B & S Commerce EOOD within 14 (fourteen) calendar days from the date of its receipt, without giving any reason. In order for your claim to be respected, you have to return the product(s) purchased from B & S Commerce EOOD in the original packaging in good commercial condition and complete set, exactly the way you have received it. The Company reserves the right to refuse approval of your claim if any of the above conditions are not met. Upon expiration of the 14-days period, a product purchased from B & S Commerce EOOD is subject only to a possible replacement, but you will not be refunded. For your convenience and information please find enclosed an excerpt of the CPA:
“Art. 50. The consumer has the right to withdraw from the contract at a distance or from the contract outside the commercial site, without giving any reason, without indemnity or penalty and without paying any expenses, except for the costs provided in Art. 54, para. 3 and Art. 55, within 14 days from the date of:
1. signing of the contract – for a service contract;
2. acceptance of the goods by the consumer or by a third party other than the carrier and indicated by the consumer – for a sales contract
Art. 52. When the consumer desires to withdraw from the contract at a distance or from the contract outside the commercial site, he shall inform the merchant of his decision before the expiry of the period under Art. 50.
Art. 55. When the consumer exercises his right to withdraw from the contract at a distance or from the contract outside the commercial site and when the merchant has not offered to collect the merchandise himself, the consumer must either send or deliver the merchandise back to the merchant or to a person authorized by him without undue delay and no later than 14 days from the date on which the consumer has informed the merchant of his decision to withdraw from the contract under Art. 52. The deadline is considered to be met if the consumer sends or returns the merchandise back to the merchant before the end of the 14-day period.
(2) The consumer shall pay only the direct expenses for the return of the merchandise under para. 1, except in the cases when the merchant has agreed to pay them or if the merchant has not informed him that the cost of returning the merchandise is payable by the consumer.

In case of manufacturing defect that is found upon product arrival, the customer has the right to return it at the expense of the merchant. The product (s) is (are) replaced by the same or similar product prior to agreement with the customer. In this case the return costs is at the expense of B & S Commerce EOOD.
If upon arrival you ascertain poor overall product condition, e.g. damaged or lack of original packaging, missing products etc, you need to fill in the courier’s bill of loading with short description of the discrepancy. If such a case occurs please contact us immediately, or refuse to accept the delivery. The circumstances (damaged or lack of original packaging, damaged product etc.) shall be clearly stated into the courier’s bill of lading. Both sides the consignee and the courier prepare a protocol where the condition of the received product (s) is described. If you accept clear bill of loading (accept shipment) on your own responsibility, without filled in any description of inconsistency and respectively without drawing a protocol, the claim might be considered invalid.
IMPORTANT! In case of claim and return of product back to B & S Commerce EOOD, pursuant to Article 55, the transportation costs shall be at the expense of the customer. The customer has the right to choose by themselves the way of return and a freight forwarding company to perform the service. If the return cost is not settled (paid) by the customer, B & S Commerce EOOD will refund the approved claim amount and the cost of return will be deducted. Returned goods shall be checked by the staff of B & S Commerce EOOD, upon their arrival, in the presence of the courier. Both the employee and the courier verify the overall condition of the returned product (s).
